Note: In some of these Orders In Council, mention is made of a physical
measurement, usually a length or distance, or an area, which is given in
Imperial units, the measurement system in general use in Canada until the
1970s. The Imperial system was abandoned some decades ago, and these
obsolete units of measure are now unfamiliar to a considerable proportion
of the population. As time goes by, more and more people will be uncertain
of the correct interpretation or translation of Imperial into modern measures.
To assist the reader's understanding, where Imperial measures occur in the
text, immediately following I have inserted, in [square brackets] the modern
equivalent. For example, 6,847 square feet [636 square metres].

It should be understood that these insertions are not part of the original text.

The Governor in Council on the report and recommendation of the Minister of Finance, with the advice of the Minister of Fisheries, dated November 12, 1996, pursuant to subsection 59(4) of Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, and Sections 7 and 16 of Chapter 174 of the Revised Statutes of Nova Scotia, 1989, the Fisheries Development Act, is pleased to:
(a) authorize financial assistance to Joey Boudreau, Ron Boudreau, Geralyn Boudreau, Michel Boudreau and Rodney Fougere of R.R.#1 West Arichat, Richmond County, carrying on business as LeBlanc Harbour Aqua-Farms Limited by way of a guarantee to a credit union in such form as the Attorney General may approve in an amount not to exceed $27,000.00 in support of an operating line of credit for $30,000.00, on terms and conditions determined by the Nova Scotia Fisheries Loan Board and set out in Schedule "A" attached to and forming part of the Report and Recommendation; and
(b) authorize the Nova Scotia Fisheries Loan Board to execute such guarantee and such other agreements and instruments as may be required to give effect to this Order.

(a) dispose of certain lands containing 4.95 acres [2.00 hectares] and 6,386 square feet [593 square metres], more or less, of land situate at or near the Town of Wolfville, Kings County, and more particularly described in Schedule "A" and shown outlined in red on Schedule "B", which Schedules are attached to and form part of the report and recommendation, which is part of the public highway system;
(b) convey the said lands to the Town of Wolfville, Kings County, in exchange for other lands; and
(c) authorize the Minister of Transportation and Public Works to make and execute a Deed of Conveyance in such form as the Minister determines.

(a) extinguish the right of the public to use that portion of the public highway system containing 2,286 square feet [212 square metres], more or less, situate at or near Chester, Lunenburg County, and more particularly described in Schedule "A" and shown outlined in red on Schedule "B", which Schedules are attached to and form part of the report and recommendation;
(b) convey the said lands to Robert J. Flinn and Paul G. Flinn of Chester, Lunenburg County, in exchange for other lands used for highway purposes; and
(c) authorize the Minister of Transportation and Public Works to make and execute a Deed of Conveyance in such form as the Minister determines.

(a) extinguish the right of the public to use that portion of the public highway system containing 0.080 hectare, more or less, situate at or near Belliveaus Cove, Digby County, and more particularly described in Schedule "A" and shown outlined in red on Schedule "B", which Schedules are attached to and form part of the report and recommendation;
(b) convey the said lands to Quentin Halliday and Ginger Halliday of R.R.#1 Weymouth, Digby County, in exchange for other lands used for highway purposes; and
(c) authorize the Minister of Transportation and Public Works to make and execute a Deed of Conveyance in such form as the Minister determines.

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated November 13, 1996, pursuant to every power and authority vested in him, is pleased to authorize the Minister of Transportation and Public Works, on behalf of Her Majesty the Queen in the Right of Her Province of Nova Scotia, to accept from Her Majesty the Queen in the Right of Canada the transfer of administration and control of a parcel of land containing 1,125 square feet [105 square metres], more or less, the said lands being situate at Nyanza, Victoria County, and being more particularly described in Schedule "A" attached to and forming part of Federal Real Property Document, File No. H-5516-129 dated September 30, 1996, and attached as Schedule "A" and outlined in red on Schedule "B", both schedules being attached to and forming part of the report and recommendation.

Doreen Crick of Halifax, Halifax Regional Municipality, as a member of the Nova Scotia Environmental Assessment Board for a term of office of three years commencing November 26, 1996 and ending November 25, 1999.

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated November 18, 1996, pursuant to Section 13 of Chapter 504 of the Revised Statutes of Nova Scotia, 1989, the Wildlife Act, and Section 7 of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, and pursuant to the terms of an Implementation Agreement signed June 16, 1994, between Ducks Unlimited Canada and Her Majesty the Queen in the right of the Province of Nova Scotia, is pleased to authorize the Minister of Natural Resources to purchase and have reconveyed to Her Majesty for the benefit of the Province of Nova Scotia the property shown outlined in red on a plan marked Schedule "A" attached to and forming part of the report and recommendation as described below for the price shown opposite and to authorize the Minister of Natural Resources to have executed the necessary documents to achieve the purpose of this Order:

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated November 20, 1996, pursuant to clause 16(1)(a) of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, and clause 19(f) of Chapter 235 of the Revised Statutes of Nova Scotia, 1989, the Interpretation Act, is pleased to further amend Order in Council 96-418 dated June 4, 1996, as amended by Order in Council 96-591, dated July 31, 1996, respecting the conveyance of a parcel of land to Cumberland District Planning Commission, by deleting from paragraph (b) thereof "125 acres [51 hectares], more or less" and substituting therefor "385 acres [156 hectares], more or less".

(a) appoint Marlene MacMillan of R.R.#3 St. Andrews, Antigonish County, as a member of the Nova Scotia Farm Loan Board for a term of office of two years commencing September 15, 1996 and ending September 14, 1998; and
(b) determine the rate of remuneration to be $100.00 per meeting for the member plus expenses in accordance with Nova Scotia government policy.

The Governor in Council on the report and recommendation of the Minister of Agriculture and Marketing dated October 30, 1996, pursuant to clause 4(1)(a) and subsections (2), (3) and (4) of Chapter 276 of the Revised Statutes of Nova Scotia, 1989, the Meat Inspection Act, is pleased to:
(a) reappoint Doug Armstrong of Kingston, Kings County, as a member of the Meat Inspection Board for a term of office of two years commencing August 1, 1996 and ending July 31, 1998;
(b) designate Doug Armstrong as the Chair of the Meat Inspection Board; and
(c) determine the rate of remuneration for the Chair to be $75.00 per day plus expenses in accordance with Nova Scotia government policy.

(a) reappoint Hattie M. Dyck of R.R.#2 Truro, Colchester County, as a member of the Nova Scotia Dairy Commission for a term of office commencing August 1, 1996 and ending July 31, 1998; and
(b) determine the rate of remuneration for the members of the Nova Scotia Dairy Commission to be $100.00 per meeting plus reimbursement for travel costs in accordance with Nova Scotia government policy.

The Governor in Council on the report and recommendation of the Minister of Labour dated October 29, 1996, pursuant to Sections 238, 239 and 244 of Chapter 10 of the Statutes of Nova Scotia, 1994-95, the Workers' Compensation Act, is pleased to:
(a) appoint Leo A. MacPhee of Sydney Mines, Cape Breton Regional Municipality, as a part-time member of the Workers' Compensation Appeals Tribunal, for a term ending December l, 1999;
(b) appoint John D. Filliter of Dartmouth, Halifax Regional Municipality, as a part-time member of the Workers' Compensation Appeals Tribunal, for a term ending December 1, 1997; and
(c) fix the remuneration of Leo A. MacPhee and John D. Filliter at the rate of $291.00 for each day they attend to the business of the Workers' Compensation Appeals Tribunal at the request of the Chief Appeals Commissioner.

The Governor in Council on the report and recommendation of the Minister responsible for the Nova Scotia Economic Renewal Agency dated October 22, 1996, pursuant to Section 4 of Chapter 339 of the Revised Statutes of Nova Scotia, 1989, the Peggy's Cove Commission Act, is pleased to:
(a) reappoint the following persons as members of the Board of Directors of the Peggy's Cove Commission, each to hold office for a term of one year commencing December 3, 1996 and ending December 2, 1997:

Rita Crooks of Peggy's Cove, Halifax Regional Municipality;
John B. Campbell of Peggy's Cove, Halifax Regional Municipality;

(b) appoint the following persons as members of the Board of Directors of the Peggy's Cove Commission, each to hold office for a term of two years commencing December 3, 1996 and ending December 2, 1998:

The Governor in Council on the report and recommendation of the Minister responsible for the Nova Scotia Economic Renewal Agency dated November 13, 1996, pursuant to Section 6 of Chapter 20 of the Statutes of Nova Scotia, 1990, the Nova Scotia Film Development Corporation Act, is pleased to amend Order in Council 96-714, dated September 24, 1996, which Order appoints the directors of the Nova Scotia Film Development Corporation for a term of office of one year, as follows:
(a) in paragraph (b) line 2 thereof deleting the words "one year" and substituting therefor the words "three years"; and
(b) in paragraph (b) line 3 thereof deleting the figures "1997" and substituting therefor the figures "1999".

(b) convey the said lands to Halifax Regional Municipality of Halifax, Halifax Regional Municipality, for the price of $450.00; and

(a) extinguish the right of the public to use land which is part of the public highway system containing 0.35 hectare, more or less, situate at or near Sperry's Beach, Petite Riviere, Lunenburg County, and more particularly described in Schedule "A" and shown outlined in red on Schedule "B" which schedules are attached to and form part of the report and recommendation;
(b) approve the transfer of administration and control of the said land to the Minister of Natural Resources.

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated November 13, 1996, pursuant to Section 26 of Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, is pleased to approve of the Minister entering into an agreement with the Town of Stellarton relating to work on certain highways within the Town, which work is specified in Maintenance Agreement No. 15-B, dated October 1, 1996, set forth in Schedule "A", the location of which is set forth on a Plan marked Schedule "B", both Schedules being attached to and forming part of the report and recommendation.

The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated November 20, 1996, pursuant to Sections 9 and 10 of Chapter 452 of the Revised Statutes of Nova Scotia, 1989, the Surplus Crown Property Disposal Act, is pleased to:
(a) authorize the Minister of Transportation and Public Works to sell and convey to AquaPrime Mussel Ranch Ltd., of R.R.#l Lake Charlotte, Halifax Regional Municipality, the property located at Ship Harbour, Halifax Regional Municipality, and more particularly described in Schedule "A" attached to and forming part of the report and recommendation for the amount of Fifty Thousand Dollars ($50,000.00) which sale shall be on the terms and conditions as are satisfactory to the Attorney General;
(b) authorize the Minister of Transportation and Public Works on behalf of Her Majesty the Queen in right of the Province of Nova Scotia to execute such documents and agreements as may be required in connection with this sale and conveyance;
(c) direct the Minister of Transportation and Public Works to forward the proceeds of the sale to the Minister of Finance for the Province of Nova Scotia to be deposited to the credit of Her Majesty the Queen in right of the Province of Nova Scotia in an appropriate account.

(a) authorize financial assistance substantially on the terms attached as Schedule "A" to the Report and Recommendation for a loan not exceeding Two Million Five Hundred Thousand Dollars ($2,500,000.00) from the Nova Scotia Development Corporation to Mentor Networks Inc. to assist it to establish its Corporate offices and facilities in Halifax, Nova Scotia, to create interactive multi-media computer skilled courseware products;
(b) authorize financial assistance substantially on terms Nova Scotia Business Development Corporation attached as Schedule "B" to the Report and Recommendation for an equity investment not exceeding Five Hundred Thousand Dollars ($500,000.00) by the Nova Scotia Business Development Corporation in Mentor Networks Inc.; and

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated December 3, 1996, pursuant to clause 16(1)(a) of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to approve the issuance of a lease by the Minister of Natural Resources of a parcel of Crown land containing 8 areas (sic) (this may mean 8 acres [3 hectares]), more or less, situate at Terence Bay, Halifax Regional Municipality, and shown outlined in red and green respectively on the plan marked Schedule "A" attached to and forming part of the report and recommendation, to Rogers Cantel Inc., a body corporate, with its head office at Ville St. Laurent, in the Province of Quebec for the purpose of constructing, maintaining and operating a telecommunications tower and related equipment and for access to the tower and for no other purpose, for a term of ten (10) years at an annual rent of Two Thousand Five Hundred Dollars ($2,500.00) with the right to renew the lease for a further ten (10) year term at a rent to be fixed by the Lessor, provided that the Lessee has satisfactorily complied with the terms and conditions of the lease.

The Governor in Council on the report and recommendation of the Minister of Natural Resources dated December 3, 1996, pursuant to clause 16(1)(a) of Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to approve the issuance of a lease of Crown land by the Minister of Natural Resources for Parcels "B" and "C" containing 3.27 acres [1.32 hectares], and 6.8 acres [2.8 hectares] respectively, situate at Lingan Road in Cape Breton Regional Municipality and shown outlined in red on the plan marked Schedule "A" attached to and forming part of the report and recommendation, to the Lingan Road Community Association, an Association duly Incorporated under the Societies Act with its head office at Lingan, Cape Breton Regional Municipality for the purpose of establishing and maintaining a recreational area only and for no other purpose, for a term of ten (10) years at the annual rent of Fifty Dollars ($50.00) plus applicable taxes, with the right to renew the lease for a further ten (10) year term at a rent to be fixed by the Lessor, provided that:
(a) the lease for Parcel "A" from the Cape Breton Regional Municipality to the Lingan Road Community Association, dated May l, 1987 remains in full force and effect. Should the lease for Parcel "A", expire and not be renewed or be earlier terminated or cancelled, then the lease for Parcels "B" and "C" will automatically terminate as of the date of expiration, cancellation or termination of the lease from Cape Breton Regional Municipality to the Lingan Road Community Association; and
(b) the Lessee has satisfactorily complied with the terms and conditions of the lease for Parcels "B" and "C".

The Governor in Council on the report and recommendation of the Minister of Health dated November 20, 1996, and pursuant to Section 26 of Chapter 15 of the Acts of 1995-96, the Queen Elizabeth II Health Sciences Centre Act, and subsection (7) of Section 3 of Chapter 235 of the Revised Statutes of Nova Scotia, 1989, the Interpretation Act, is pleased to order and declare by proclamation that clause (d) of subsection (1) of Section 6 of Chapter 15 of the Acts of 1995-96, the Queen Elizabeth II Health Sciences Centre Act, come into force on and not before December 17, 1996.

(a) make regulations in the form attached to and forming part of the report and recommendation as Schedule "A";
(b) amend the regulations made pursuant to the Regional Health Boards Act by Order in Council 96-189, dated March 26, 1996, in the manner attached to and forming part of the report and recommendation as Schedule "B";
(c) amend the regulations made pursuant to Schedules "A" and "B" of Order in Council 96-733, dated October 1, 1996 in the manner attached to and forming part of the report and recommendation as Schedules "C" and "D" respectively; and
